MEDICAL MARIJUANA JH 11/27/12

MENDOCINO COUNTY SHERIFF TOM ALLMAN CONFIRMS THE SUBPOENA THE COUNTY RECEIVED IN LATE OCTOBER FROM THE US ATTORNEYS OFFICE FOR RECORDS THE COUNTY KEEPS REGARDING ITS MEDICAL MARIJUANA ORDINANCE.

WHILE ALLMAN HAS SAID IT IS NOT CLEAR TO HIM WHY FEDERAL AUTHORITIES WANT THE RECORDS FROM A NOW-CANCELLED PERMITTING PROGRAM FOR COLLECTIVES TO GROW UP TO 99 MEDICAL MARIJUANA PLANTS, HE NOTED THAT APPLICANTS HAD TO SIGN A WAIVER ACKNOWLEDGING THE FACT THAT THE PERMIT COMPLIED WITH STATE LAW, BUT PROVIDED NO IMMUNITY FROM PROSECUTION FROM FEDERAL LAW. THE PERMITTING PROGRAM ENDED IN MARCH AND REVERTED TO THE STATES 25-PLANT LIMIT FOR ALL GROWERS AFTER THE US ATTORNEYS OFFICE THREATENED TO FILE AN INJUNCTION AGAINST THE COUNTYS MEDICAL MARIJUANA ORDINANCE AND SEEK LEGAL ACTION AGAINST ALL COUNTY OFFICIALS WHO SUPPORTED IT. ACCORDING TO ALLMAN, UNTIL WE GET TO A POINT WHERE THE LAWS ARE BLACK AND WHITE, WERE GOING TO CONTINUE TO HAVE A LOT OF MISUNDERSTANDING ABOUT WHAT VOTERS INTENT WAS IN THE PASSAGE OF PROPOSITION 215, THE COMPASSIONATE USE ACT OF 1996.
