HOME INVASION SUSPECTS EXPECTED TO BE CHARGED (LAW) JB 11/6/14

FOUR SOUTHERN CALIFORNIA MEN TIED TO AN OCTOBER UKIAH VALLEY HOME INVASION WERE ARRAIGNED WEDNESDAY IN MENDOCINO COUNTY SUPERIOR COURT.

THE UKIAH DAILY JOURNAL REPORTED THAT JONATHAN OTERO-CRUZ, FILOMENO NUNEZ, JOSE CABRERA AND CHRISTOPHER MONTOYA WERE RELEASED INTO THE CUSTODY OF THE MCSO BY THE SONOMA COUNTY SHERIFFS OFFICE, AS THE GROUP WAS FACING SIMILAR CHARGES IN SONOMA COUNTY. PUBLIC DEFENDERS WERE APPOINTED TO REPRESENT ALL FOUR MEN, WHO ENTERED NOT GUILTY PLEAS ON THE SUSPECTED CHARGES. THE DISTRICT ATTORNEY HAS FILED 23 COUNTS AGAINST THE MEN, INDIVIDUALLY AND COLLECTIVELY, WITH 33 SPECIAL ALLEGATIONS RELATING TO THE CRIMES. A PRELIMINARY HEARING IS SCHEDULED FOR DECEMBER 9 IN MENDOCINO COUNTY SUPERIOR COURT.

NEW GUIDELINES FOR SENTENCING TRESPASS GROWS (LAW) JB 11/6/14

THE U.S. SENTENCING COMMISSION HAS FINALIZED GUIDELINES TO INCREASE PENALTIES FOR ENVIRONMENTAL DAMAGE CAUSED BY TRESPASS MARIJUANA GROWS.

THE SENTENCING GUIDELINES ARE THE RESULT OF A LETTER PENNED BY CONGRESSMAN JARED HUFFMAN, ASKING THAT THE FEDERAL AGENCY JOIN IN WORKING TO COUNTER THE ENVIRONMENTAL DAMAGES CAUSED BY ILLEGAL DRUG PRODUCTION. THE NEW SENTENCING COMMISSION GUIDELINES, WHICH BECAME EFFECTIVE ON NOVEMBER 1, WILL, FOR THE FIRST TIME, COUNT ENVIRONMENTAL DAMAGES SUCH AS WATER DIVERSIONS AND VEGETATION REMOVAL AS SEPARATE OR AGGRAVATING OFFENSES.

FT BRAGG CITY COUNCIL, HEALTH CARE ELECTION (GOV) JB 11/6/14

ACCORDING TO PRELIMINARY RESULTS, NO INCUMBENTS WERE RETURNED TO EITHER THE FT BRAGG CITY COUNCIL OR THE MENDOCINO COAST HEALTHCARE DISTRICT BOARD.

IN A RELATIVELY CLOSE RACE, MICHAEL CIMOLINO WITH 21 PERCENT, LINDY PETERS WITH 21 PERCENT, AND MARK IACUANIELLO WITH 20 PERCENT WERE ELECTED TO THE FORT BRAGG CITY COUNCIL, EDGING OUT THE INCUMBENTS, MAYOR DAVE TURNER AND HEIDI KRAUT. WILLIAM ROHR, PETER GLUSKER AND KITTY BRUNING WERE ELECTED TO THE HOSPITAL DISTRICT BOARD, REPLACING INCUMBENT JOHN KERMEN AND MICHAEL CARROLL.

SHAMROCK RANCH CONTROL BURN SCHEDULED (LAW) JB 11/6/14

A CONTROL BURN IS SCHEDULED FOR THE NEXT TWO DAYS ON THE SHAMROCK RANCH IN THE NORTHERN PART OF MENDOCINO COUNTY.

STARTING AT NOON ON THURSDAY AND FRIDAY THIS WEEK, CAL FIRE WILL BE CONDUCTING A VEGETATION MANAGEMENT CONTROL BURN ON PRIVATELY OWNED LAND ON THE SHAMROCK RANCH SOUTH OF LAYTONVILLE. THE GOALS OF THE BURN ARE TO IMPROVE WILDLIFE HABITAT AND TO REDUCE OVERALL FUEL LOADING TO DECREASE THE CHANCE OF CATASTROPHIC WILDFIRES IN THE FUTURE. THIS BURN PROJECT WILL BE CONDUCTED UNDER STRICTLY CONTROLLED WEATHER AND FUEL CONDITIONS AND SMOKE IS TO BE EXPECTED IN THE AREA DURING THE NEXT TWO DAYS.

SUSPECTED HONEY OIL LAB SHED EXPLODES IN UKIAH (LAW) JB 11/6/14

A SHED CONTAINING A SUSPECTED HONEY OIL LAB EXPLODED IN UKIAH TUESDAY NIGHT, INJURING TWO MEN.

UVFA FIREFIGHTERS RESPONDED TO A RESIDENCE ON LUCE AVENUE AFTER A CALLER REPORTED THAT A SHED AT THE ADDRESS HAD EXPLODED AND WAS ON FIRE. FIRE AUTHORITIES STATED THAT THE SHED APPEARED TO BE USED TO GROW MARIJUANA AND PRODUCE HONEY OIL BASED ON THE NUMBER OF BUTANE TANKS AT THE SCENE. TWO VICTIMS OF THE BLAST WERE AIRLIFTED TO AREA HOSPITALS FOR TREATMENT, ONE WITH BURNS ON MORE THAN 60 PERCENT OF HIS BODY. THE CAUSE OF THE EXPLOSION IS UNDER INVESTIGATION BUT PRELIMINARY REPORTS SHOW THAT A LIT CIGARETTE IGNITED THE BUTANE, TURNING IT INTO A FIREBALL.

BOS ASKS TO RE-ESTABLISH FRIDAY HOURS FOR HHSA (GOV) JB 11/6/14

THE MENDOCINO COUNTY BOARD OF SUPERVISORS HAS BEEN ASKED TO RE-ESTABLISH FRIDAY HOURS FOR CERTAIN COUNTY OFFICES.

THE UKIAH DAILY JOURNAL REPORTED THAT THE COURT APPOINTED SPECIAL ADVOCATES FOR MENDOCINO AND LAKE COUNTIES HAS REQUESTED THAT THE BOARD OF SUPERVISORS REINSTATE A FRIDAY WORKING SCHEDULE OF THE MENDOCINO COUNTY HEALTH AND HUMAN SERVICES AGENCY. IN ACCORDANCE WITH THE ECONOMIC RECESSION, THE HHSA, INCLUDING CHILD PROTECTIVE SERVICES AND THE PUBLIC HEALTH DEPARTMENT, BEGAN CLOSING DEPARTMENTAL OFFICES ON FRIDAYS AS DIRECTED BY THE COUNTY IN 2009 TO REDUCE ITS HOURS AND FUNDING LIABILITY. ACCORDING TO THE REQUEST BY CASA, THE NEED FOR FURLOUGH HOURS HAS CEASED AND THE PUBLIC IS INADEQUATELY BEING SERVED BY THE CONTINUED CLOSURES.

UPDATE ON SECOND AMENDMENT CHALLENGE (LAW) JB 11/6/14

AN UPDATE HAS BEEN RELEASED ON THE FEDERAL SECOND AMENDMENT CHALLENGE TO CALIFORNIAS 10-DAY GUN PURCHASE WAIT PERIOD AS APPLIED TO KNOWN GUN OWNERS.

CALIFORNIA ATTORNEY GENERAL KAMALA HARRIS AS APPEALED HER LOSS IN THE FEDERAL CASE TO THE NINTH CIRCUIT COURT OF APPEALS. HOWEVER, BEFORE THE CASE PROCEEDS AT THE NINTH CIRCUIT, SENIOR DISTRICT COURT JUDGE ISHII MUST FIRST RULE ON TWO PENDING MOTIONS BY HARRIS. THE FIRST IS TO EXTEND THE TIME THE DOJ HAS TO COMPLY WITH THE ORDER FROM 6 MONTHS TO 12 MONTHS, AND THE SECOND IS TO STAY THE ORDER PENDING THE NINTH CIRCUITS RESOLUTION OF THE APPEAL. ONCE BOTH MOTIONS HAVE BEEN RULED ON, THE CASE WILL CONTINUE ON APPEAL AT THE NINTH CIRCUIT.

CONCRETE POURED ON FOR TWO BYPASS BRIDGES (TR) JB 11/6/14

CONCRETE ON TWO BRIDGES ON THE WILLITS BYPASS PROJECT ARE BEING POURED THIS WEEK.

AS PROGRESS SLOWLY CONTINUES ON THE WILLITS BYPASS PROJECT, TWO BRIDGES IN THE STRETCH ARE HAVING CONCRETE POURED THIS WEEK. THE TWO BRIDGES, ONE FOR THE NORTHBOUND SECTION AND ONE OF THE SOUTHBOUND SECTIONS OF ROAD, ARE HAVING THE SIDES AND INSIDE STEMS POURED, WITH THE DECK SOON TO FOLLOW DEPENDING ON THE WEATHER. CALTRANS SLOWS DOWN THE POURING OF CONCRETE IN THE WINTER, BUT WILL CONTINUE CONCRETE WORK THROUGH NOVEMBER, WEATHER PERMITTING. FAVORABLE WORKING WEATHER COULD EXTEND THE WORK INTO JANUARY.
