DEPUTIES SHOOT, KILL MAN WHO CHARGED WITH KNIFE (LAW) JB 11/11/14

A LUCERNE MAN WAS SHOT AND KILLED BY DEPUTIES EARLY SUNDAY AFTER HE CHARGED THEM ARMED WITH A KNIFE.

THE INCIDENT OCCURRED JUST AFTER MIDNIGHT SUNDAY MORNING AT AN ADDRESS ON 16TH AVENUE IN LUCERNE. DEPUTIES HAD RESPONDED TO THE RESIDENCE TO THE REPORT OF A DOMESTIC DISPUTE BETWEEN A HUSBAND AND WIFE. WHEN THE RESPONDING DEPUTIES ARRIVED AT THE HOME, THE HUSBAND SUDDENLY CHARGED AT THEM WITH A KNIFE AND THE DEPUTIES FATALLY SHOT THE MAN DURING THE ATTACK. DEPARTMENT OFFICIALS HAVE NOT RELEASED THE NAME OF THE ATTACKER OR OF THE TWO DEPUTIES INVOLVED IN THE INCIDENT AND AN INTERNAL AFFAIRS INVESTIGATION IS CURRENTLY UNDERWAY.

PROP 47 IMPACTS BEGIN FOR LOCAL LAW ENFORCEMENT (LAW) JB 11/11/14

THE IMPACTS OF RECENTLY ADOPTED PROPOSITION 47 HAVE BEGUN FOR LOCAL LAW ENFORCEMENT AND PROSECUTORS.

THE LAKE COUNTY NEWS REPORTED A PROPOSITION CALIFORNIA VOTERS PASSED LAST TUESDAY TO REDUCE SOME CRIMES FROM FELONIES TO MISDEMEANORS ALREADY HAS GONE INTO EFFECT AND IS IMPACTING LOCAL LAW ENFORCEMENT AS WELL AS THE PROSECUTION OF CRIMINAL CASES. PROPOSITION 47, THE SAFE NEIGHBORHOODS AND SCHOOLS ACT, PASSED 58.7 PERCENT TO 41.3 PERCENT, BASED ON THE SECRETARY OF STATES PRELIMINARY REPORT ON THE TUESDAY GENERAL ELECTION. AMONG THE FELONIES REDUCED TO MISDEMEANORS UNDER THE NEW LAW ARE COMMERCIAL BURGLARIES, FORGERIES AND BAD CHECKS, MOST FIREARM THEFTS, AMD POSSESSION OF DRUGS INCLUDING COCAINE, CONCENTRATED CANNABIS, HEROIN, ILLEGAL PRESCRIPTIONS AND METHAMPHETAMINE. THE NEW LAW WENT INTO IMMEDIATE EFFECT THE DAY AFTER THE ELECTION AND, IN HUMBOLDT COUNTY, EIGHT INMATES HAVE ALREADY BEEN RELEASED DUE TO RESENTENCING, WITH MORE RELEASES EXPECTED. IN LAKE COUNTY, ALTHOUGH NO INMATES HAVE BEEN RELEASED YET, THE DISTRICT ATTORNEY GAVE A BALLPARK ESTIMATE OF FIFTY CASES THAT WILL SEE CHARGING CHANGES AS A RESULT OF PROP 47. IN SOME CASES FELONS MAY ALREADY BE OUT OF PRISON BUT STILL WANT THEIR FELONY CONVICTIONS REDUCED. OPPONENTS OF THE MEASURE POINT OUT THAT REDUCED SENTENCING COULD MEAN SOME OF THESE INDIVIDUALS WOULD HAVE CERTAIN RIGHTS, SUCH AS THE RIGHT TO VOTE AND THE ABILITY TO PURCHASE A HANDGUN, IMMEDIATELY REINSTATED.

CAL AQUIFERS CONTAMINATED FROM FRACKING (EVR) JB 11/11/14

ON THE HEELS OF BANNING FRACKING IN MENDOCINO COUNTY, IT HAS BEEN CONFIRMED THAT AQUIFERS IN CENTRAL CALIFORNIA HAVE BEEN CONTAMINATED WITH BILLIONS OF GALLONS OF FRACKING WASTEWATER.

AFTER CALIFORNIA STATE REGULATORS SHUT DOWN 11 FRACKING WASTEWATER INJECTION WELLS LAST JULY OVER CONCERNS THAT WASTEWATER MIGHT HAVE CONTAMINATED AQUIFERS USED FOR DRINKING WATER AND IRRIGATION, THE EPA ORDERED A REPORT WITHIN 60 DAYS. IT WAS REVEALED YESTERDAY THAT THE CALIFORNIA STATE WATER RESOURCES BOARD HAS SENT A LETTER TO THE EPA CONFIRMING THAT AT LEAST 9 OF THOSE SITES WERE IN FACT DUMPING WASTEWATER CONTAMINATED WITH FRACKING FLUIDS AND OTHER POLLUTANTS INTO AQUIFERS PROTECTED BY STATE LAW AND THE FEDERAL SAFE WATER DRINKING ACT. THE FULL EXTENT OF THE CONTAMINATION IS NOT YET KNOWN.

DA WINS MAX PRISON TERM IN DUI CASE (LAW) JB 11/11/14

A SACRAMENTO MAN HAS BEEN SENTENCED IN MENDOCINO COUNTY SUPERIOR COURT TO FIVE YEARS IN STATE PRISON FOR FELONY DRUNK DRIVING.

42 YEAR OLD MICHAEL DON ANDERSON RECEIVED THE MAXIMUM SENTENCE ALLOWED AFTER HE SERIOUSLY INJURED THREE MEMBERS OF A VACATIONING FAMILY WHEN HIS VEHICLE CROSSED LANES ON HIGHWAY 1 IN MID-JUNE ON THE MENDOCINO COAST AND COLLIDED HEAD ON WITH THEIR RENTAL CAR. THE DEPUTY DISTRICT ATTORNEY STATED THAT THE COURT REJECTED PROBATION AND IMPOSED THE MAXIMUM SENTENCE GIVEN THE GRAVITY OF THE ACCIDENT, AND ANDERSONS PAST CRIMINAL RECORD. THIS IS ANDERSONS THIRD FELONY CONVICTION AS AN ADULT.

DOMESTIC VIOLENCE IN FORT BRAGG (LAW) JB 11/11/14

A REPORTED ROAD RAGE INCIDENT IN FORT BRAGG LEADS TO THE ARREST OF A WOMAN ON DOMESTIC BATTERY CHARGES.

FORT BRAGG POLICE WERE DISPATCHED SATURDAY EVENING TO THE CHEVRON ON SOUTH MAIN STREET TO THE REPORT OF A ROAD RAGE INCIDENT. IT WAS REPORTED THAT 27-YEAR-OLD MARIA LLAMAS HAD BEEN FOLLOWING HER EX-BOYFRIEND AROUND TOWN AND HAD ATTEMPTED TO STOP HIS CAR BY JUMPING ON IT. LLAMAS HAD ALSO CONFRONTED THE VICTIM AT THE CLIFF HOUSE RESTAURANT AND CONTINUED FOLLOWING HIM AROUND TOWN, AT TIMES BLOCKING THE ROADWAY WITH HER VEHICLE. LLAMAS WAS LOCATED BY POLICE AND ARRESTED ON MULTIPLE CHARGES INCLUDING DOMESTIC VIOLENCE AND FALSE IMPRISONMENT.

4 CALIFORNIA GUN DEALERS HAVE FILED FIRST AMENDMENT LAWSUITS AGAINST ATTORNEY GENERAL KAMALA HARRIS AND THE CALIFORNIA DEPARTMENT OF JUSTICE.

TRACY RIFLE AND PISTOL, A FIREARM DEALER IN SAN JOAQUIN COUNTY, WAS RECENTLY CITED BY HARRIS DEPARTMENT OF JUSTICE FOR HAVING PICTURES OF THREE HANDGUNS IN WINDOW SIGNS THAT CAN BE SEEN OUTSIDE THE STORE, A VIOLATION OF A CALIFORNIA PENAL CODE FROM 1923. WHILE CALIFORNIA GUN DEALERS CANNOT DISPLAY EVEN THE WORD HANDGUN AT THEIR STORES TO PASSERBY, ADJACENT BUSINESSES AND ANTI-GUN PROTESTERS ARE NOT PROHIBITED FROM DOING AS MUCH. THE COURT FILINGS ARGUE THAT THE LAW OPERATES AS DISCRIMINATORY AND A VIOLATION OF FIRST AMENDMENT RIGHTS.

FUNDING FOR EMERGENCY SHELTER PUT IN PLACE (GOV) JB 11/11/14

FUNDING FOR AN EMERGENCY WINTER HOMELESS SHELTER IN UKIAH HAS BEEN PUT IN MOTION.

THE UKIAH DAILY JOURNAL REPORTED THAT THE MENDOCINO COUNTY BOARD OF SUPERVISORS APPROVED TO MOVE FORWARD WITH THE COUNTY MATCH OF $26,200 TO ESTABLISH AN EMERGENCY WINTER HOMELESS SHELTER AT THE BUDDY ELLER CENTER IN UKIAH. THE SUPERVISORS HAD BEEN HEARING FROM THE HOMELESS SERVICES PLANNING GROUP-AD HOC EMERGENCY SHELTER COMMITTEE AND THE HHSA OVER THE PAST FEW MONTHS WHICH BOTH VOICED CONCERNS ABOUT NOT HAVING A SHELTER AVAILABLE AGAIN DURING THE WINTER MONTHS. THE BUDDY ELLER CENTER IS SLATED TO REOPEN ON DECEMBER 1.
